Election tiebreaker process critiqued at hearing

Opponents of a procedure recently used to break Hawaii election ties criticized a plan to adopt the process as a rule for future elections during a public hearing Monday. Opponents of the procedure used to break Hawaii election ties were critical at a public hearing, which included two candidates who lost tiebreaker drawings in the Aug. 8 primary election. The Office of Elections has been ordered to adopt administrative rules to establish a procedure for breaking election ties. The proposed rule requires names drawn from a container that is shaken or rotated, and the person who selects the winning name must not be the same person handling the container. Rep. Kanani Souza (R), who lost a tiebreaker drawing in the Republican primary to Sheila Medeiros, argued that the procedure was invalid as it hadn't been established as an administrative rule by the Office of Election. Sen. Kurt Fevella, who lost another tiebreaker, filed an election challenge with the high court on grounds similar to Souza's, but his challenge was ruled invalid.
